Terms of Service

Terms governing access to Fact0's audit trail platform, API, and dashboard.

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and YASH JAYESHKUMAR CHAUHAN ("Fact0", "we", "us") for use of the Fact0 platform at https://fact0.io, the dashboard at https://app.fact0.io, the API at https://api.fact0.io, documentation at https://docs.fact0.io, and related services (collectively, the "Service").

By creating an account, signing in, or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Fact0 provides a universal fact layer with tamper-evident audit logging, execution telemetry, cryptographic chain verification, share links, and compliance-oriented exports for AI agent workloads. Features, limits, and availability may change as we improve the product.

We grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription or free-tier period, subject to these Terms and applicable plan limits.

3. Accounts and workspaces

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account and for API keys issued in your workspaces.

Workspaces may have multiple members with role-based access. You are responsible for inviting only authorized personnel and for actions taken by members you authorize.

  • Do not share API keys in public repositories, client-side code, or unsecured channels.
  • Rotate keys promptly if you suspect compromise.
  • Notify us at yash@fact0.io if you believe an account was accessed without authorization.

4. Customer data

"Customer Data" means audit events, telemetry, execution records, metadata, and other content you or your agents submit to the Service, plus configuration you store in the dashboard.

You retain ownership of Customer Data. You grant Fact0 the rights necessary to host, process, transmit, display, and back up Customer Data solely to provide and improve the Service, comply with law, and enforce these Terms.

You represent that you have all rights and consents required to submit Customer Data, including personal data contained in agent logs. You are responsible for your agents' data collection practices.

5. Acceptable use

You agree not to:

  • Use the Service to violate law, infringe rights, or transmit malware or abusive content.
  • Attempt to bypass security, probe systems without authorization, or interfere with other customers.
  • Reverse engineer the Service except where prohibited restrictions are unenforceable by law.
  • Resell or sublicense the Service without our written consent.
  • Use the Service to store regulated health, payment card, or other data categories unless we have agreed in writing to support them.

7. Plans, billing, and trials

Free and paid plans are described on our website. Usage limits, retention, and feature access may differ by plan. Paid plans are billed according to the order form or checkout terms in effect at purchase.

Unless stated otherwise, subscriptions renew automatically until canceled. Fees are non-refundable except where required by law or explicitly stated in your order.

8. Availability and support

We strive for high availability but do not guarantee uninterrupted operation. Maintenance, third-party outages, or force majeure may affect access. Enterprise customers may receive separate uptime commitments in an order form.

9. Intellectual property

Fact0 and its licensors own the Service, software, branding, and documentation. Feedback you provide may be used to improve the Service without obligation to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACT0 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Fact0 helps you record and verify agent actions; it does not replace your legal, compliance, or security obligations. You remain responsible for how you deploy agents and interpret audit evidence.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACT0 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, risk to the Service, or legal requirement. Upon termination, your right to access the Service ends; export provisions in your plan and our Privacy Policy govern data retention and deletion.

13. Changes

We may update these Terms. We will post the revised Terms with an updated date and, for material changes, provide reasonable notice via the Service or email. Continued use after the effective date constitutes acceptance.
